
An appeals court recently upheld a policy allowing ICE to detain the majority of people it seeks to deport, strengthening the administration’s legal footing for expanded detention. While many courts have still limited mandatory-detention practices, the Supreme Court’s recent rulings permitting deportations and border turnbacks add momentum to enforcement efforts across the system. Individual court-ordered releases continue to constrain detention in practice, leaving legal uncertainty despite the recent wins.
